INTRODUCTION

At Quimidex we work to offer you the best possible experience through our products and services. In some cases, it is necessary to collect information to achieve this. We care about your privacy and believe we must be transparent about it. Therefore, for the purposes of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter, the “GDPR”), and Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (hereinafter, the “LSSI”), Quimidex hereby informs users that, as data controller, it will process the personal data provided by users.

COLLECTION OF PERSONAL DATA AND ITS PROCESSING

Below is an indication of the personal data we may process on our website, as well as the legal basis that justifies such processing:

• Contact form: To manage this form, data such as your name, email address and any other information you wish to include in the message box will be processed. Personal data such as your telephone number and surname may be collected as optional fields in the relevant form.
• Marketing communications: In order to manage any marketing communications and/or newsletter subscription regarding our products and services, we will need to process your email address.
• Browsing information through cookies: If you accept the installation of cookies while browsing our website, we may process the following personal data such as your IP address, and other non-personal data such as user agent, the date and time you accessed our services, the internet browser you use and information about the operating system of your device. LEGAL BASIS FOR PROCESSING YOUR DATA

The legal basis that justifies the processing of your data referred to above is:

• The data subject’s consent for the contracting of services and products; for contact forms, information requests or newsletter sign-ups; for submitting sample requests; participating in promotions and prize draws; granting access to the information available in the private area; and the processing of personal data in relation to optional cookies accepted by the user.
• Compliance with legal obligations for fraud prevention, communications with public authorities and third-party claims.

RETENTION OF YOUR PERSONAL DATA

The processing of data for the purposes described will be maintained for as long as necessary to fulfil the purpose for which it was collected, as well as to comply with the legal obligations arising from the processing. Without prejudice to retention being necessary for the establishment, exercise or defence of potential claims and/or whenever permitted by applicable law. RECIPIENTS TO WHOM WE DISCLOSE YOUR DATA

In some cases, only when necessary, Quimidex will provide your data to third parties. However, data will never be sold to third parties.

External service providers used by Quimidex to provide ancillary services for the processing of your data may have access to it, in accordance with Quimidex’s instructions and solely for the purpose of properly performing the contractual relationship between Quimidex and its providers.

Quimidex seeks to ensure the security of personal data when it is sent outside the company and ensures that third-party service providers respect confidentiality and have appropriate measures in place to protect personal data. These third parties are obliged to ensure that information is processed in accordance with data privacy regulations.

In some cases, the law may require personal data to be disclosed to public bodies or other parties; only what is strictly necessary to comply with such legal obligations will be disclosed.

STORAGE OF PERSONAL DATA

In general, your personal data will be stored within the EU. However, if the processing of your personal data involves an international transfer of data outside the European Economic Area (EEA), Quimidex undertakes to implement the necessary security measures to ensure an adequate level of protection for such transfers by means of data processing agreements and, where applicable, will ensure that they provide an adequate level of protection, either because they have Binding Corporate Rules (BCRs) or because we have entered into the European Commission’s standard contractual clauses.

EXERCISE OF RIGHTS AND HOW YOU CAN EXERCISE THEM

Under the GDPR, you may request:

• Right of access: you may request information about the personal data we hold about you.
• Right to rectification: you may request that we update your personal data if your circumstances have changed or if any personal data we hold is inaccurate.
• Right to erasure and the right to be forgotten: you may request the deletion of your personal data at any time. Please note that, legally, personal data to be erased is first blocked for the legally established period, in accordance with the provisions of the applicable Spanish Organic Law on Data Protection.
• Right to restriction of processing: you may request that we restrict the processing of your personal data for a specified period of time.
• Right to data portability: in some cases, you may request a copy of your personal data in a structured, commonly used and machine-readable format so that it can be transmitted to another controller.
• Right to object and automated individual decision-making: you may request that decisions not be made based solely on automated processing, including profiling, that produce legal effects concerning you or similarly significantly affect you.

Likewise, if you have a complaint about the processing of your data, you may lodge a complaint with the competent data protection authority.

RESPONSIBILITY FOR THE ACCURACY AND TRUTHFULNESS OF THE DATA PROVIDED

The user is solely responsible for the truthfulness and correctness of the data provided, and Quimidex is released from any liability in this regard. Users guarantee and, in any case, are responsible for the accuracy, validity and authenticity of the personal data provided, and undertake to keep it duly updated. The user undertakes to provide complete and correct information in the registration or subscription form. Quimidex reserves the right to terminate contracted services with users if the data provided is false, incomplete, inaccurate or not up to date.

Quimidex is not responsible for the truthfulness of information that it has not produced itself and for which another source is indicated; therefore, it assumes no liability for any potential damages that may arise from the use of such information.

Quimidex reserves the right to update, modify or delete the information contained on its web pages and may even limit or deny access to such information.

SECURITY MEASURES APPLIED TO PROTECT YOUR PERSONAL DATA

Quimidex has adopted the legally required levels of security for the protection of personal data and endeavours to implement any other additional technical means and measures within its reach to prevent the loss, misuse, alteration, unauthorised access and theft of personal data provided to Quimidex.

Quimidex shall not be liable for any potential damages arising from interference, omissions, interruptions, computer viruses, telephone faults or disconnections in the operational functioning of this electronic system due to causes beyond Quimidex’s control; or for delays or blockages in the use of this electronic system caused by deficiencies or overloads of telephone lines or overloads in the Data Processing Centre, in the internet system or in other electronic systems; nor for damage that may be caused by third parties through unlawful intrusions beyond Quimidex’s control. Nevertheless, the user should be aware that security measures on the internet are not foolproof.

AMENDMENTS TO THE PRIVACY POLICY

This Privacy Policy may be amended. We recommend that you review the Privacy Policy from time to time.
